In Venezuela, the justice system faces a structural crisis that transcends citizen distrust, becoming the primary obstacle to the country’s social and economic stability. As a consultant lawyer at Tuozzo Consulting, I have observed with grave concern how current laws and decrees have been weaponized to incarcerate innocent individuals, often for the mere act of expressing political dissent. This reality demands an integral reform that guarantees respect for human rights, judicial independence, and procedural transparency.

The Judicial Crisis and its Impact on Corporate Legal Security
The Venezuelan justice system has lost its legitimacy due to severe political co-optation. The establishment of what legal scholars call "Enemy Criminal Law", where citizens and economic actors are arbitrarily detained for their ideas, directly attacks the Rule of Law.
This climate of discretion generates an institutional "country risk" that paralyzes the Venezuelan business sector. Companies, from SMEs to large corporations, require a predictable environment to operate and grow. Without impartial courts, contracts lose their executive force, property rights become precarious, and capital retreats, stagnating the national productive apparatus.
Toward the Purging of the Repressive Normative Framework
To restore justice, it is imperative to repeal the laws and decrees that have served as the scaffolding for political and economic persecution. Regulations such as the "Anti-Hate Law" and other restrictive norms against civil society have been used as tools of coercion, contravening constitutional principles and international Human Rights treaties.
The repeal of these laws is not only an act of justice but a fundamental step toward rebuilding institutional trust. Consequently, a legal framework must be promoted that protects freedom of expression and guarantees fair, transparent judicial processes. This reform must include clear mechanisms for reviewing cases of arbitrary detention and providing full reparation to victims, including officials and military personnel prosecuted for reasons of conscience.
Judicial Independence: The Shield of the Productive Sector
Judicial independence is the cornerstone of any effective and reliable justice system. Judicial independence is bolstered by transparent selection and evaluation processes. Ending the practice of provisional appointments and ensuring tenure based on professional merit allows judges to operate without fear of arbitrary removal, certifying technical fitness and impartiality.
Transparency in Public Management and Economic Protection:
Promoting radical transparency helps to eliminate administrative arbitrariness. Preventing the creation of discretionary fees or resolutions that burden the private sector is vital. Ensuring that local regulations undergo legality validations can prevent bureaucratic extortion and support a healthy business climate.
Professional Training and Digital Supervision:
Implementing continuous training in human rights and procedural law for judicial officials is fundamental. These efforts should be paired with digital systems that reduce discretionary contact, ensuring that all sectors of society are equally protected by the law.
